SETTLERS HOSPITALITY GROUP (Fairview House) VACATION RENTAL SHORT-TERM LEASE AGREEMENT This Vacation Rental Short-Term Lease Agreement (this `Agreement`) constitutes a contract between the undersigned person (`you`) and Settlers Hospitality Group, LLC Properties, Inc. (`Settlers Hospitality Group, LLC” or “SHG”). 1. Reservation Requirements and Full Payment. Reservations are not considered `guaranteed` until Settlers Hospitality Group, LLC receives your signed Agreement and receives and accepts the required deposit and full payment. If your signed Agreement and full payment is not received and accepted by Settlers Hospitality Group, LLC at least 14 days prior to your arrival, your reservation is subject to cancellation. You agree that Settlers Hospitality Group, LLC may charge your card on file for the remaining balance after deposit without notice no earlier than 30 days before arrival. Reservations cancelled before 30 days prior to arrival will forfeit initial deposit. Reservations cancelled within 30 days of arrival will forfeit entire deposit. Consideration may be offered in extenuating circumstances. 2. Deposit to Secure your Reservation. You must pay a reservation deposit when making your reservation in the amount of 50% or one night of the cost of your vacation rental, whichever is greater. The remainder of the Reservation amount is due thirty (30) days prior to your arrival. You waive all rights to bank account interest that may accrue on your deposit. A fee of $50 will be charged for returned checks. In the event of a cancellation, the initial deposit paid is non-refundable. If a reservation has been paid in full, and cancellation is made before 30 days prior to check-in, a 50% refund will be issued. No refunds will be extended if reservation is cancelled within 30 days of arrival. 3. Confirmation of Reservation(s). Confirmation of your reservation will be emailed to you. Please read the confirmation for accuracy of dates, mailing address, number of adults and/or children and accommodations. You must notify Settlers Hospitality Group, LLC of any errors within one business day. 4. Security Deposit. Settlers Hospitality Group, LLC shall also require a security deposit at least thirty (30) days prior to your arrival, or at the time of reservation, if the reservation is less than thirty (30) days prior to arrival, in the amount of $300 or 15% of the total payment, whichever is greater. Settlers Hospitality Group, LLC shall take a pre-authorization for the security deposit of $300, but not charge it to you at that time. After checkout, if there are damage issues it shall then be charged; if not, Settlers Hospitality Group, LLC shall clear the hold. This deposit will be refunded in whole or in part at Settlers Hospitality Group, LLC s discretion after your departure and an inspection of the premises by Settlers Hospitality Group, LLC. The Security Deposit shall also be refunded if you cancel prior to taking occupancy of the rental unit. 5. Maximum Occupancy. The maximum occupancy for the rental property is fourteen (14), including children. If you bring in extra guests, you may be asked to vacate the rental property and forfeit all rent paid. 6. Visitors: A visitor is an occupant in the rental property that is not staying overnight. The total number of persons permitted in a rental property including visitors is 200% of the maximum occupancy for the property. Any visitor staying overnight is considered a guest and subject to additional charges and may result in termination of your occupancy. Any occupancy for daily use in excess of the maximum is a violation of this agreement. 7. Excessive Wear and Tear; Damage. You are responsible for rental charges for the full duration of the reservation and for any damages or breakage to the rental property incurred during the rental period, even if a security deposit has been paid. Settlers Hospitality Group, LLC may charge the credit card on file for any damage or breakage or excessive cleaning costs but will provide a statement if such charges are billed. 8. Agreement to Comply with all Rental Regulations. You and your invitees and visitors must comply with all Rental Regulations set forth on Exhibit A to this Agreement (the `Rental Regulations`). Failure to comply with the Rental Regulations and any reservations made under false pretenses may result in loss of all your payments made to Settlers Hospitality Group, LLC and possible removal of you from the rental property, in addition to all other remedies available to Settlers Hospitality Group, LLC. If you violate any of the conditions of this Agreement or the Rental Policies, Settlers Hospitality Group, LLC may enter the rental property and you agree to vacate the rental property immediately upon the request of Settlers Hospitality Group, LLC and forfeit all rent paid. Use of endless pool with hot tub features and sauna is at the risk of the TENANT as described in this Lease. Silver Birches Resort and all agents do not assume any liability for the use or misuse of provided amenity or its surrounding structures. You will follow all pool use instructions to include: showering/rinsing before use of the pool and sauna. Should the pool be found cloudy and/or dirty due to body oils or lotions and require draining; the TENANT will be charged an excess cleaning fee (See Exhibit A). There is to be NO running on the pool deck. NO jumping or diving into the pool. NO glass is permitted inside the pool area. NO food is permitted in the pool. Use only the striped/pool towels with pool use. Silver Birches Maintenance team will be allowed in the house twice a week to ensure the endless pool is maintained properly. We are happy to schedule a time in advance with you. Use of Fairview Lake access is as described in this Lease; you assume all risks involved with its use. When in season, access will include 1 kayak and use of swim dock. No boats are permitted to be tied to the Fairview Lake Dock. The Fairview Lake Dock is shared with neighboring houses. All lake rules are to be followed by you and your guests and any injuries, violations or property damage are your responsibility. Silver Birches Resort and all associated agents hold no liability or responsibility. 9. Designated Parking. Settlers Hospitality Group, LLC shall provide a plan showing permissible parking locations at the rental property. Fairview House has parking for 6 cars. If you or your guests and visitors fail to park in the proper location, you may be subject to tickets or even towing and you shall be responsible for the costs of same. 10. Mechanical Failures. Settlers Hospitality Group, LLC cannot guarantee against mechanical failure of electrical service, stopped plumbing, water supply, heating, audio visual equipment, computers or internet access, television or appliances. Please report any inoperative equipment to Settlers Hospitality Group, LLC immediately. Settlers Hospitality Group, LLC will make every reasonable effort to have repairs done quickly and efficiently. No refunds or rent reductions will be made due to failure of such items. 11. Rental Assignment Change. Settlers Hospitality Group, LLC reserves the right to require you to change rental properties without liability to Settlers Hospitality Group, LLC if the rental property unexpectedly becomes unavailable or uninhabitable. When comparable accommodations are unavailable, you will have the option of selecting from available properties or receiving a refund. 12. Listing Information. Information regarding individual rental properties is believed accurate but cannot be guaranteed. Particular furnishings and amenities are subject to change without notice. 13. FORCE MAJEURE. Neither Party will be liable for any failure or delay in performing an obligation under this Agreement that is due to any of the following causes, to the extent beyond its reasonable control: acts of God, accident, riots, war, terrorist act, epidemic, pandemic, quarantine, civil commotion, breakdown of communication facilities, breakdown of web host, breakdown of internet service provider, natural catastrophes, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, generalized lack of availability of raw materials or energy. For the avoidance of doubt, Force Majeure shall not include (a) financial distress nor the inability of either party to make a profit or avoid a financial loss, (b) changes in market prices or conditions, or (c) a party`s financial inability to perform its obligations hereunder. 14. Indemnification and Hold Harmless. You shall indemnify and hold harmless the owner of the rental property and Settlers Hospitality Group, LLC and its respective manager, members, employees and agents for any liabilities, theft, damage, personal injury, cost or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with your and your invitees` and visitors` use and occupancy of the rental property or the failure of you and your invitees or visitors to observe the Rental Regulations. 15. Property Rental Owner is a Third-Party Beneficiary.
